O Decreto 9.450, que institui a Política Nacional de Trabalho no Âmbito do Sistema Prisional, está publicado na edição de hoje (25) do Diário Oficial da União. A política tem medidas para dar oportunidades de trabalho a presos e ex-detentos. O texto foi assinado na terça-feira (24) pela presidente da República interina, Cármen Lúcia.
A medida vale para contratação de serviços pela União, inclusive os de engenharia, com valor anual acima de R$ 330 mil. Os presos provisórios, em regime fechado, semiaberto e aberto estão incluídos na política. Além disso, os egressos – aqueles que já cumpriram pena e foram postos em liberdade – também podem ser contratados dentro da cota.
Para ter o direito de participar da iniciativa, os detentos devem ser autorizados pelo juiz de Execução Penal; ter cumprido, no mínimo, um sexto da pena; e comprovar aptidão, disciplina e responsabilidade. Os serviços previstos no decreto não incluem o emprego de presos ou egressos no canteiro de obras, apenas em serviços adjacentes à obra, como limpeza ou vigilância.
Deverão ser reservados aos presos ou egressos 3% das vagas quando o contrato demandar 200 funcionários ou menos; 4% das vagas, no caso de 201 a 500 funcionários; 5% das vagas, no caso de 501 a 1.000 funcionários; e 6% quando o contrato exigir a contratação de mais de 1.000 funcionários.
