O Instituto Nacional do Seguro Social (INSS) vai recorrer da decisão do Superior Tribunal de Justiça (STJ) de conceder acréscimo de 25% no benefício mensal pago pela Previdência Social a todos os aposentados que precisam de auxílio permanente de terceiros. O órgão informou que aguarda a publicação da decisão para análise do julgamento e, principalmente, para interposição dos recursos cabíveis.
A decisão foi tomada ontem (22) por 5 votos a 4 pela Primeira Seção da Corte. Antes da decisão, o acréscimo era garantido somente para aposentados por invalidez que precisavam pagar um cuidador, conforme está previsto na Lei de Benefícios Previdenciários, norma que específica os benefícios aos quais os segurados têm direito.
Conforme o entendimento do STJ, o adicional será pago mesmo nos casos em que o aposentado recebe o teto do Instituto Nacional do Seguro Social (INSS), definido em R$ 5.645,80 para 2018.
A decisão da Primeira Seção deve servir de base para outros processos que estão em tramitação na Justiça Federal em todo o país.
