A Procuradoria-Geral da República (PGR) enviou parecer ao Superior Tribunal de Justiça (STJ) se manifestando contra o pedido da defesa do ex-presidente Luiz Inácio Lula da Silva para que o juiz federal Sérgio Moro seja considerado suspeito para julgar a ação penal relacionada ao sítio da Atibaia. Para a PGR, o juiz tem sido imparcial em todo o processo.
No parecer, a PGR afirmou que todas as teses de nulidade apresentadas pela defesa do ex-presidente já foram julgadas improcedentes pelas instâncias inferiores da Justiça e mostram mero inconformismo com as decisões de Moro. “Assim, inviável a declaração de nulidade de todos os atos praticados no curso da ação penal processada e julgada pelo Juízo Criminal Federal de Curitiba, que se manteve imparcial durante toda a marcha processual”, afirmou a procuradoria.
Na ação penal, que é presidida por Moro, na 13ª Vara Federal em Curitiba, Lula é acusado pelo Ministério Público Federal (MPF) de receber como vantagens indevidas reformas realizadas no Sítio Santa Bárbara, em Atibaia (SP), frequentado pela família do ex-presidente.
No laudo elaborado pela Polícia Federal, em 2016, sobre o sítio de Atibaia, os peritos citam as obras que foram realizadas, entre elas a de uma cozinha avaliada em R$ 252 mil. A estimativa é de que tenha sido gasto um valor de cerca de R$ 1,7 milhão, somando a compra do sítio (R$ 1,1 milhão) e a reforma (R$ 544,8 mil).
