O Ministério Público do Estado do Espírito Santo (MPES), por meio da Promotoria de Justiça de Conceição da Barra, ajuizou Ação Civil Pública por ato de improbidade administrativa em desfavor da presidente da Câmara Municipal, vereadora Mirtes Eugenia Rodrigues Pereira Figueiredo, do vereador Almir Maia Machado e do servidor comissionado Filipe dos Santos Machado, sobrinho do parlamentar.
Na ação, o MPES pede a perda da função pública, a suspensão dos direitos políticos de 3 a 5 anos, pagamento de multa de até 100 vezes o valor da remuneração percebida pelos agentes, proibição de contratar com o poder público ou receber benefícios ou incentivos fiscais ou creditícios, direta ou indiretamente, ainda que por intermédio de pessoa jurídica da qual seja sócio majoritário, pelo prazo de 3 anos.
O Ministério Público Estadual sustenta que a presidente da Câmara e o vereador cometeram nepotismo ao nomear o sobrinho do parlamentar para atuar em cargo comissionado no Legislativo de Conceição da Barra. Para o MPES, “os requeridos violaram os princípios constitucionais da moralidade administrativa, impessoalidade, igualdade e legalidade que regem a administração pública”.
